As a condition of submitting any bid in the auction, bidders release the Rotary Club of Amherst, ACTV, all auction donors, and their affiliates (and in each case their employees, agents, owners, officers, members, Board members, spouses, heirs and affiliates) from any liabilities or claims of any kind arising from execution of any bid, and from any failures to correctly execute any such bid or any competing bid, and from any loss, injury or consequential damages of any kind resulting from the possession or use of any auction item. Further, bidders agree that all auction items are sold in �as is� condition,� and that auction reports pertaining to the value, condition or authenticity of auction items are provided only as a courtesy to potential bidders, and are not meant to be a warranty or guarantee of the item.
